Toramama is a platform that connects parents with course providers, allowing them to search, attend, and pay for courses, as well as review and comment on their experiences. This Terms of Service and Privacy Policy (“Agreement”) outlines the terms and conditions under which you (“User”) access and use the Toramama platform.
Terms Of Service
- Account Registration: To use Toramama, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality and security of your account.
- Course Booking and Payment: Toramama facilitates course bookings and payments between Users and course providers. You agree to pay the course fees and any applicable taxes and charges.
- Course Cancellations and Refunds: Course cancellations and refunds are subject to the course provider’s policies. Toramama is not responsible for any refunds or cancellations.
- Reviews and Comments: You may post reviews and comments about courses and course providers. You agree to post accurate and respectful content, and Toramama reserves the right to remove or edit content that violates this Agreement.
- Intellectual Property: Toramama owns all intellectual property rights in and to the platform, including trademarks, trade secrets, and copyrights. You agree not to reproduce, modify, or distribute any content without permission.
Ownership of Data
- User Data: Toramama collects and owns all data provided by Users, including personal information, course bookings, and reviews. You grant Toramama a perpetual, irrevocable, and royalty-free license to use and distribute this data.
- Course Provider Data: Toramama collects and owns all data provided by course providers, including course information and availability. Course providers grant Toramama a perpetual, irrevocable, and royalty-free license to use and distribute this data.
Pricing and Settlement
- Pricing: Toramama reserves the right to change course prices and fees at any time without notice.
- Settlement: Toramama will settle payments with course providers according to the agreed-upon terms.
Liability and Indemnification
- Liability: Toramama is not liable for any damages or losses arising from the use of the platform, including but not limited to course cancellations, refunds, or disputes with course providers.
- Indemnification: You agree to indemnify and hold harmless Toramama, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, damages, or expenses arising from your use of the platform.
Privacy Policy
- Personal Information: Toramama collects personal information, including name, email address, phone number, and payment information.
- Usage Data: Toramama collects usage data, including course bookings, attendance, and reviews.
- Cookies and Tracking Technologies: Toramama uses cookies and tracking technologies to collect data about your use of the platform.
- Data Protection: Toramama takes reasonable measures to protect your data from unauthorized access, disclosure, or use.
- Data Sharing: Toramama may share your data with course providers, payment processors, and other third-party service providers to facilitate the platform’s functionality.
Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of Hong Kong. Any disputes arising from this Agreement shall be resolved through binding arbitration in accordance with the rules of Hong Kong.
Changes to this Agreement
Toramama reserves the right to modify or update this Agreement at any time without notice. Your continued use of the platform constitutes your acceptance of the updated Agreement.
